“PARTICIPATION IS CONQUERING: A CONSTANT BECOMING, ALWAYS DOING ITSELF”

Abstract

Considering that law by law is abstraction, since it must live by praxis, by spirit, we aim to discuss the process of participation as "a constant becoming, always becoming". We emphasize political and sociocultural aspects that exist among humans. We contemplate article 230, Chapter 7, of the Constitution of the Federative Republic of Brazil, trying to unveil family, society and state duties towards the elderly. On the other hand, we highlight the social and cultural heritage represented by the elderly. We point out, as a challenge for today's world, participation as a shaping force of a just, solidary, ethical society. For this, it is necessary to balance theory and practice, in an authentic condition of unity of opposites, as Demo teaches us (1996, p. 1).
