A Justiça como instrumento de repressão na República da Espada (1889–1894).

Resumo: O presente artigo examina o papel da justiça como um instrumento de repressão política durante a República da Espada (1889-1894), período marcado por uma ditadura militar no Brasil. A pesquisa apresenta como a Constituição Federal de 1891 e outros dispositivos legais foram mobilizados na repressão de membros da oposição ao regime ditatorial e para justificar os atos autoritários do Regime. A partir da análise de fontes primarias, como os decretos e decisões judiciais, além da Constituição Federal de 1891 e o discurso com historiografia recente, busca-se compreender quais dispositivos e como eles foram utilizados para dar legalidade aos atos do Marechal Deodoro da Fonseca (1827-1892), primeiro Presidente da República e do Marechal Floriano Peixoto (1839-1895), segundo Presidente da República. O artigo contribui para a discussão e análise sobre a construção da República no Brasil e a relação entre militarismo, autoritarismo e direito no Brasil do final do Século XIX.
Abstract: The following article examines the role of justice as an instrument of political repression during the Republic of the Sword (1889-1894), a period marked by a military dictatorship in Brazil. The research presents how the 1891 Federal Constitution and other legal provisions were used to suppress opposition to the regime and to justify authoritarian actions. Based on the analysis of primary sources, such as decrees and judicial decisions, as well the 1891 Federal Constitution and recent historiographical discourse, the article seeks to understand which legal provisions and how they were used to legitimates the actions of Marechal Deodoro da Fonseca (1827-1892), the first President of Brazil and Marechal Floriano Peixoto (1839-1895), the second President of Brazil. The article contributes to the discussion and analysis of the construction of the Republic in Brazil and the relations between militarism, authoritarianism and law on Brazil at the end years of the XIX Century.
