Resumo

O presente trabalho tem por escopo investigar em que medida os profissionais do Direito têm em sua formação acadêmica componentes curriculares especializados e voltados para a área da Educação. Para tanto, realizou-se uma pesquisa qualitativa, alicerçada em bibliografia e legislação pertinente, bem como na verificação empírica das matrizes curriculares e dos projetos políticos pedagógicos dos cursos de graduação em Direito ofertados pelas Universidades Federais brasileiras. Nossos estudos acabaram por demonstrar que a grande maioria desses cursos ainda não contempla, em suas propostas curriculares, a disciplina de Direito Educacional, ou seja, caminhamos pouco em relação às recomendações emitidas, em 1977, no “1º Seminário de Direito Educacional”. Tal descaso com o Direito Educacional é um sinal de que as graduações em Direito das Universidades Federais caminham no sentido de uma gestão centralizada e não intersetorial. Evidencia-se, assim, certa desarticulação entre o discurso político das Universidades e os nortes estabelecidos pelas políticas públicas federais.

ABSTRACT

This work has the scope to investigate if the legal professionals have in their specialized academic curriculum components focused on the area of Education. Therefore, a qualitative research was conducted, seeking data in the literature and in the relevant legislation, as well as empirical verification of the curriculum grids and political-pedagogical projects of graduation courses in Law offered by Brazilian Federal Universities. Our studies showed that the vast majority of Law courses still do not include in their curriculum the discipline of Educational Law. In other words, few of these courses have been adapted to the recommendations of the ‘1st Educational Law Seminar’, issued in 1977. Such disregard for the Educational Law is a sign that the degrees in Law of Federal Universities go towards a centralized management and not towards an intersectorial management. It is evident, therefore, a certain disconnection between the political discourse of these Universities and the path established by Federal Public Policies.
